The www.thebossarchitect.com, www.kendrajlewis.com, and credit-architect.com website (the "Site") is comprised of various web pages operated by The Boss Architect LLC ("The Boss Architect"). www.thebossarchitect.com, www.kendrajlewis.com, and credit-architect.com is offered to you conditioned on your acceptance without modification of the terms, conditions, and notices contained herein (the "Terms"). Credit Architect Program
Our goal is to help you acquire credit in your business name without providing a personal guarantee. We want you to give your best effort to apply all of the strategies in the course. We offer a 30-day refund period for purchases.
With respect to any purchase, you must request your money back within 30 days of the purchase. You may request your money back by emailing firstname.lastname@example.org. That email must contain information about the product you purchased, the date of the purchase, and the email and name associated with any such purchase.
We will NOT provide refunds more than 30 days following the date of purchase. After day 30, all payments are non-refundable and you are responsible for full payment of the fees.

Section 2. Client Responsibilities.
(a) Client is solely responsible for the decision to implement and implementation of any ideas, concepts, teachings, or the like, presented in the Program. Client agrees that TBA is not and will not be liable or responsible for any action or inaction or for any direct or indirect result of Client’s use of the ideas, concepts, teachings, or the like, presented in the Program or for Client’s use of any materials provided by TBA in connection with the Program. Client agrees and understands that TBA makes no guarantees regarding the success of Client resulting from the Program.
(b) Client is responsible for participating in the Program in a manner that does not disrupt or impair the Program for any other participants, instructors, TBA employees or contractors.
(c) Client agrees to treat information shared by other Program participants confidential.
(d) Client acknowledges that TBA reserves the right to terminate a Client’s participation in the Program for violation of the terms of this Agreement.
Section 3. Fees and Payment. Payment information includes:
Cost for the Program is $8,000 (EIGHT THOUSAND DOLLARS)
Client agrees to pay TBA with either credit/debit card, bank transfer (ACH or wire) in 4 (FOUR) installments of $2,250 (TWO THOUSAND TWO HUNDRED FIFTY DOLLARS) each, which will be automatically charged to the account information on file by TBA on the payment(s) due date(s)
Payment due dates are in successive thirty (30) day intervals immediately following the prior payment, unless otherwise specified above
Client must notify TBA of any changes to its billing information at least two (2) business days prior to the payment due date
TBA is authorized to collect the full amount due by charging any/all cards on file in smaller intervals not to exceed the total payment amount due
Client represents and warrants that (1) the billing information that Client supplies to TBA is true, correct, and complete, (2) Client is duly authorized to use such accounts, cards, or funds for the purchase, and (3) charges incurred by Client will be honored by its credit card company, bank and other account providers
Payments are final, non-refundable, and non-transferable. If Client does not comply with its payment obligations, TBA may remove Client from the Program
Section 4. Acknowledgement of TBA Intellectual Property Rights. Client acknowledges the ownership by TBA of all copyright, trademark, service mark, know how, trade secrets and other intellectual property rights in the Program content. Client acknowledges that Program content is for individual use only and agrees not to copy, sell, reproduce, record, share, teach, give away, or otherwise divulge Program content without the express written consent of TBA. Reproduction or distribution of Program content is strictly prohibited. Client acknowledges that a breach of its agreements regarding TBA’s intellectual property rights will cause irreparable damage to TBA and its goodwill, the exact amount of which be difficult to ascertain and the remedy of monetary damages will be inadequate. Accordingly, Client agrees that in the event of a breach of its agreements regarding TBA’s intellectual property rights, in addition to any other remedy that may be available at law or in equity, TBA shall be entitled to specific performance and injunctive relief.
Section 5. Non-Solicitation. During the Program and for a period of one (1) year after separation from the Program, whether such separation results completion or termination, Client will not except with the prior written consent of TBA, directly or indirectly, either as an individual or as a partner or joint venture or as an employee, sales representative, principal, consultant, agent, shareholder, officer or director, for any person, firm, association, organization syndicate, company or corporation, or in any other manner whatsoever, contact, solicit, or attempt to solicit any of the persons, clients, employees, companies or institutions with whom you had dealings through the Program (1) to competing with TBA to provide the same or similar services which TBA is currently providing to any of these individuals or companies, (2) to leave the employ or engagement of TBA, or (3) to sell or offer for sale or solicit orders for the sale of any products or services.
Section 7. Right to Use Name & Likeness. Client irrevocably permits, authorizes, grants and licenses TBA and its affiliates, successors, and assigns the right to use my photograph, likeness, voice, and or quotes or excerpts of my written or verbally expressed words, my name, and testimonial (individually or collectively referred to as “Likeness”) for any lawful purposes, including publicity, marketing, and promotion of TBA and its programs without restriction or limitation as to geography or time. Client waives any right to inspect or approve the product or material in which my Likeness may be used. Client agrees that TBA is and will be the sole and exclusive owner of all right, title, and interest in and to the above-referenced materials, including all copyrights and any other intellectual property rights therein. Client assigns to TBA any right, title, and interest, including any copyright, in the above-referenced materials.
Section 8. Miscellaneous.
(a) Governing Law and Remedies. Any disputes arising under this Agreement or Client’s participation in the Program shall be governed by the laws of the state of Georgia without regarding its principles of conflicts of law. Any dispute arising under this Agreement or Client’s participation in the Program shall be submitted to a state or federal court located in Fulton County, Georgia, which shall have exclusive jurisdiction over the dispute and to which jurisdiction the Parties irrevocably submit.
(b) Class Action Waiver. Each Party waives the right to litigate in court any claim or dispute as a class action, either as a member of a class or as a representative. Any court action hereunder shall proceed solely on an individual basis.
(c) No Waiver. No waiver by either party of any default will be deemed as a waiver of any prior or subsequent default of the same or of another provision of this Agreement.
(d) Amendments. This Agreement will not be modified or amended except in writing signed by both parties.
(e) Entire Agreement. This Agreement contains the entire understanding between the Parties with respect to the subject matter of this Agreement and supersedes any and all prior agreements or understanding between the parties on the subject matter hereof.
(f) Severability. The invalidity or unenforceability of any particular provision of this Agreement will not affect the validity or enforceability of the other provisions, and this Agreement will be construed in all respects as if the invalid or unenforceable provision were omitted; provided, however, that if the omitting of such provision results in a material alteration of this Agreement, the remaining provisions of this Agreement shall be adjusted equitably so that no Party benefits disproportionately.

The Boss Architect reserves the right, at its own cost, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will fully cooperate with The Boss Architect in asserting any available defenses.
In the event the parties are not able to resolve any dispute between them arising out of or concerning these Terms and Conditions, or any provisions hereof, whether in contract, tort, or otherwise at law or in equity for damages or any other relief, then such dispute shall be resolved only by final and binding arbitration pursuant to the Federal Arbitration Act, conducted by a single neutral arbitrator and administered by the American Arbitration Association, or a similar arbitration service selected by the parties, in a location mutually agreed upon by the parties. The arbitrator's award shall be final, and judgment may be entered upon it in any court having jurisdiction. In the event that any legal or equitable action, proceeding or arbitration arises out of or concerns these Terms and Conditions, the prevailing party shall be entitled to recover its costs and reasonable attorney's fees. The parties agree to arbitrate all disputes and claims in regards to these Terms and Conditions or any disputes arising as a result of these Terms and Conditions, whether directly or indirectly, including Tort claims that are a result of these Terms and Conditions. The parties agree that the Federal Arbitration Act governs the interpretation and enforcement of this provision. The entire dispute, including the scope and enforceability of this arbitration provision shall be determined by the Arbitrator. This arbitration provision shall survive the termination of these Terms and Conditions.
Class Action Waiver
Any arbitration under these Terms and Conditions will take place on an individual basis; class arbitrations and class/representative/collective actions are not permitted. THE PARTIES AGREE THAT A PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN EACH'S INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PUTATIVE CLASS, COLLECTIVE AND/ OR REPRESENTATIVE PROCEEDING, SUCH AS IN THE FORM OF A PRIVATE ATTORNEY GENERAL ACTION AGAINST THE OTHER. Further, unless both you and The Boss Architect agree otherwise, the arbitrator may not consolidate more than one person's claims, and may not otherwise preside over any form of a representative or class proceeding.
THE INFORMATION, SOFTWARE, PRODUCTS, AND SERVICES INCLUDED IN OR AVAILABLE THROUGH THE SITE MAY INCLUDE INACCURACIES OR TYPOGRAPHICAL ERRORS. CHANGES ARE PERIODICALLY ADDED TO THE INFORMATION HEREIN. THE BOSS ARCHITECT LLC AND/OR ITS SUPPLIERS MAY MAKE IMPROVEMENTS AND/OR CHANGES IN THE SITE AT ANY TIME.
THE BOSS ARCHITECT LLC AND/OR ITS SUPPLIERS MAKE NO REPRESENTATIONS ABOUT THE SUITABILITY, RELIABILITY, AVAILABILITY, TIMELINESS, AND ACCURACY OF THE INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS CONTAINED ON THE SITE FOR ANY PURPOSE. The Boss Architect reserves the right, in its sole discretion, to terminate your access to the Site and the related services or any portion thereof at any time, without notice. To the maximum extent permitted by law, this agreement is governed by the laws of the State of Minnesota and you hereby consent to the exclusive jurisdiction and venue of courts in Minnesota in all disputes arising out of or relating to the use of the Site. Use of the Site is unauthorized in any jurisdiction that does not give effect to all provisions of these Terms, including, without limitation, this section.
You agree that no joint venture, partnership, employment, or agency relationship exists between you and The Boss Architect as a result of this agreement or use of the Site. The Boss Architect's performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of The Boss Architect's right to comply with governmental, court and law enforcement requests or requirements relating to your use of the Site or information provided to or gathered by The Boss Architect with respect to such use. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect.
Unless otherwise specified herein, this agreement constitutes the entire agreement between the user and The Boss Architect with respect to the Site and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the user and The Boss Architect with respect to the Site. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. It is the express wish to the parties that this agreement and all related documents be written in English.
Changes to Terms
